Welcome to VEROSHAPE. VEROSHAPE is operated by AKAB LLC. These Terms of Service govern your access to and use of our website, store, products, features, tools and related services (collectively, the “Services”).
By visiting, interacting with or purchasing through the Services, you agree to these Terms and our Privacy Policy . If you do not agree to these Terms, you should not use the Services.
1. ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state, province or country of residence, or that you have the legal authority required to use the Services.
You agree that information you provide to us, including your name, email address, billing information and shipping information, is accurate, current and complete.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to display and describe our products accurately. However, colors, textures and appearance may vary depending on your screen, device settings, lighting and other factors.
Product descriptions, specifications, availability, packaging, features and other information may be updated where appropriate.
VEROSHAPE products are apparel products and are not medical devices. Information provided through the Services is not intended as medical advice, diagnosis or treatment.
We reserve the right, where permitted by law, to limit quantities, discontinue products or restrict sales by person, order, geographic region or jurisdiction.
3. ORDERS AND ORDER ACCEPTANCE
Placing an order constitutes an offer to purchase. An order is subject to acceptance by VEROSHAPE.
Where permitted by applicable law, we may decline, cancel or review an order for legitimate reasons including:
- Payment authorization or verification issues
- Suspected fraud or unauthorized payment activity
- Incorrect pricing or obvious website errors
- Inventory or fulfillment issues
- Shipping restrictions
- Unusually large or abusive order quantities
- Suspected unauthorized resale or violation of these Terms
If we cancel an order after collecting payment, any amount due back will be refunded in accordance with applicable law and the circumstances of the cancellation.
Please review your order carefully before submitting it. Once fulfillment has begun, changes or cancellations cannot be guaranteed.
Purchases are also subject to our Returns & Refunds Policy , without limiting any mandatory consumer rights that apply to you.
4. PRICES, PROMOTIONS AND BILLING
Prices, discounts, bundle offers and promotions may change without notice unless otherwise stated.
The price applicable to your purchase is the price confirmed at checkout, subject to correction of obvious errors where permitted by law.
Unless expressly stated otherwise, product prices do not include shipping, taxes, customs duties or import charges that may apply.
Promotions may have separate terms. If specific promotional terms conflict with these Terms, the specific promotional terms will control for that promotion to the extent permitted by law.
You represent that you are authorized to use the payment method submitted with your order and that the billing information you provide is accurate.
5. SHIPPING AND DELIVERY
Shipping methods, dispatch information and estimated delivery times are described in our Shipping & Delivery Policy .
Delivery dates and transit times are estimates and may be affected by carriers, customs authorities, weather, holidays, local logistics or other circumstances outside our reasonable control.
Risk of loss or damage passes in accordance with applicable law. Nothing in these Terms is intended to transfer risk to a consumer earlier than permitted by mandatory consumer law.
6. RETURNS, EXCHANGES AND REFUNDS
VEROSHAPE offers eligible purchases a 60-Day Money-Back Guarantee, subject to the eligibility, return authorization, product condition, shipping, inspection and refund requirements set out in our Returns & Refunds Policy .
Nothing in our commercial return policy is intended to exclude consumer rights that cannot legally be excluded or limited.
7. SIZE SELECTION
Because VEROSHAPE is a compression garment, fit can differ from a standard undershirt or T-shirt.
We provide sizing information and a Find Your Size tool to help customers select an appropriate starting size.
Receiving the size selected and confirmed in your order but later preferring a different fit or compression level is not considered a fulfillment error by VEROSHAPE. Exchanges remain subject to our Returns & Refunds Policy.
8. INTELLECTUAL PROPERTY
The Services and their content, including trademarks, trade names, logos, text, product descriptions, images, graphics, photographs, videos, audio, designs, layouts and other materials, are owned by or licensed to VEROSHAPE, AKAB LLC or their respective licensors and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, republish, modify, sell, exploit or create derivative works from protected content without prior authorization.
Nothing in these Terms grants you ownership or a license to use any VEROSHAPE trademark, branding or intellectual property except as expressly permitted.
9. OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools, applications, integrations or functionality supplied by third parties.
Third-party tools are provided subject to their own terms and policies. To the extent permitted by law, VEROSHAPE is not responsible for the operation or availability of services controlled by third parties.
10. THIRD-PARTY LINKS
The Services may contain links to websites or platforms operated by third parties.
We do not control third-party websites and are not responsible for their content, privacy practices, security or separate transactions. You should review the applicable third-party terms before using those services.
11. RELATIONSHIP WITH SHOPIFY
VEROSHAPE is powered by Shopify, which provides technology that enables us to operate the Services.
Purchases made through VEROSHAPE are transactions between you and VEROSHAPE / AKAB LLC, not Shopify.
To the fullest extent permitted by applicable law, Shopify is not responsible for products sold by VEROSHAPE or for disputes arising directly from transactions between you and VEROSHAPE.
12. PRIVACY
Our collection, use and disclosure of personal information is described in our Privacy Policy . Because the Services are hosted by Shopify, certain information may also be processed by Shopify as described in that policy.
13. FEEDBACK, REVIEWS AND USER CONTENT
If you submit reviews, photographs, suggestions, ideas, feedback or other content to us, you represent that you have the rights necessary to provide that content.
You grant VEROSHAPE a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, display, distribute, adapt and publish such content for purposes including operating, improving and promoting the Services, subject to applicable law.
You may not submit content that is unlawful, fraudulent, misleading, infringing, defamatory, abusive, malicious or that violates the rights of another person.
14. ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may occasionally contain typographical errors, technical errors, inaccuracies or omissions relating to product descriptions, availability, prices, promotions, shipping costs or delivery estimates.
Where permitted by law, we reserve the right to correct such errors, update information and, where reasonably necessary, cancel affected orders. If an affected paid order is cancelled, any refund legally due will be processed accordingly.
15. PROHIBITED USES
You may not use the Services:
- For unlawful, fraudulent or malicious purposes
- To violate applicable laws or regulations
- To infringe intellectual property or privacy rights
- To provide false or misleading information
- To impersonate another person or entity
- To transmit malware, viruses or harmful code
- To interfere with the security or operation of the Services
- To scrape or collect data unlawfully
- To engage in abusive, deceptive or unauthorized commercial activity
16. SUSPENSION AND TERMINATION
Where permitted by law, we may suspend or restrict access to the Services if we reasonably believe these Terms have been violated, fraudulent activity has occurred, or use of the Services threatens VEROSHAPE, Shopify, other customers or third parties.
Provisions that by their nature should survive termination will remain effective, including intellectual property, limitations of liability, indemnification and governing law provisions.
17. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE OR AVAILABLE AT ALL TIMES.
NOTHING IN THIS SECTION EXCLUDES WARRANTIES, REMEDIES OR CONSUMER RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
18. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AKAB LLC, VEROSHAPE AND THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY WHERE SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY APPLICABLE LAW.
19. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless AKAB LLC, VEROSHAPE and their affiliates, officers, directors, employees, contractors, agents and service providers from third-party claims, losses, damages and reasonable costs arising from your material breach of these Terms, your violation of applicable law, or your infringement of another person's rights.
20. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and severed to the minimum extent necessary. The remaining provisions will continue in effect.
21. WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms, together with the policies and terms incorporated by reference, constitute the agreement governing your use of the Services, subject to rights that cannot be waived under applicable law.
22. ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a legitimate business transaction, restructuring, merger, acquisition or transfer of the business, subject to applicable law.
23. GOVERNING LAW
These Terms and your use of the Services are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except to the extent mandatory laws applicable to you provide otherwise.
Nothing in this section deprives a consumer of mandatory protections, rights or remedies provided by the laws that apply to that consumer and cannot legally be waived.
24. ORDER ISSUES AND PAYMENT DISPUTES
If you believe there is a problem with an order, payment, shipment, product, return or refund, please contact VEROSHAPE Customer Service so that we have an opportunity to investigate the issue and provide the appropriate resolution.
When contacting us, please provide your order number and relevant supporting information. Nothing in this section limits any legal rights you may have regarding payments or consumer disputes.
25. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements or other operational needs.
The current version will be posted on this page with an updated “Last updated” date. Where required by law, we will provide additional notice of material changes.
